Port Arthur firm must pay more than $170000 in OT ? Business ...

Port Arthur-based Performance Blasting and Coating must pay $170,622 in back overtime pay to 314 current and former painters and sandblasters, following a U.S. Department of Labor investigation.

The department?s Wage and Hour Division determined that the company only paid straight time when employees worked more than 40 hours in a week, not the time-and-a-half required by the Fair Labor Standards Act (FLSA).

Investigators also found several record-keeping violations.

Note: The company avoided harsher penalties by immediately consenting to pay the employees and agreeing to abide by the FLSA in the future.
